So from what I understand of that Luke, is we cannot claim UK child benefit here....... Most strange as I know there are alot of people on this forum who do claim it as it has been discussed before. Unless of course I am totally stupid and misunderstood the leaflet!

I fully expected to lose my child benefit and child tax credit when I came to Spain, but when I advised the relevant departments I found out that as long as I am unable to work and getting incapacity benefit I still get them.

I knew Incapacity benefit was still payable, and it is based on National Insurance contributions. You still get your NI contributions paid whilst you are on it. I think this is why I am still eligible for the CTC and CB.

I haven't done anything illegal, all the relevant departments know where I am, I was just pleasantly surprised that for once doing the right thing went in my favour!

All this information seems to be buried deep in government leaflets and websites - you never find out unless you dig deep enough!
